Burglar shot, caught with spy camera draws prison sentence

Macon – A man shot last year after being found unlawfully inside his ex-girlfriend’s south Bibb County home pleaded guilty Wednesday to burglary and was sentenced to 10 years, three of them in prison.

If the case had gone to trial, prosecutor David Rhoden would have presented evidence showing:

Blake Elliot Herman, 35, of Macon, had previously dated a woman, but the woman later ended the relationship. For revenge, Herman broke into his ex-girlfriend’s Jones Road home and placed a small surveillance camera in her bedroom.

Herman entered the home without consent March 21, 2016, to remove the camera and was discovered when his ex-girlfriend’s brother unexpectedly arrived.  The brother told authorities Herman was wearing a ski mask and gloves.

An altercation ensued that continued outside. Herman reached into his pockets, causing his ex-girlfriend’s brother concern that he might be reaching for a gun. The brother shot Herman twice in the leg.

At some point, the spy camera fell out of Herman’s pocket.

The shooting was deemed justified and no charges were filed against the ex-girlfriend’s brother.

As part of his sentence, Herman is barred from contacting the woman or her family and he must perform 300 hours of community service.

Speaking after the hearing, Macon Judicial Circuit District Attorney David Cooke said, “After what Mr. Herman did, he’s lucky to be alive. Anyone who violates another person’s privacy and burglarizes a home should expect to face serious consequences.”
