District Attorney’s Office to hold Records Restriction information session

Macon – The Macon Judicial Circuit District Attorney’s Office will hold a Records Restriction information session from 5 to 7 p.m. May 6 in Courtroom C of the Bibb County courthouse.

O.C.G.A. 35-3-37 provides for the restriction of certain criminal history records for non-criminal justice purposes (such as for employment) when approved by a prosecuting attorney.

A person may be eligible for records restriction if:

  • The person was arrested for a crime and the case was disposed of without a conviction, or
  • The person was convicted of certain misdemeanors while under age 21, or
  • The person successfully completed a Pre-Trial Intervention or Diversion program, or
  • The person successfully completed a conditional discharge sentence

Prosecutors will be on hand during the May 6 event to answer general questions about the records restriction process and eligibility for records restriction. Applications for records restriction also will be available.

“Not only is this the right thing to do, it’s a proven method for reducing crime. Nothing stops a bullet like a job,” said District Attorney David Cooke. “When eligible applicants are able to pursue education and get jobs, our entire community benefits.”

Due to the background check required for the records restriction process, no records will be restricted on site during the event. While prosecutors will be able to answer questions, they are not able to provide legal advice. Representatives from the Macon Judicial Circuit Public Defender’s Office and Georgia Legal Services also will be attending the event to answer questions and provide information about services offered by their offices.
