Code Enforcement Processes

Standard Code Violation

  • A complaint is received by phone, mail, email, or officer area survey.
  • The complaint is assigned to an officer who inspects the property.
  • Notice of violation is mailed to the property owner (Certified and Standard)
  • Owners have between 30 – 60 days to comply.
  • If not corrected a citation will be issued for court with possible fines.

Blight Tax Properties

  • A complaint is received by phone, mail, email, or officer area survey.
  • The complaint is assigned to an officer who inspects the property.
  • The property MUST be vacant.
  • The code officer completes a blight inspection form.
  • County Attorneys review forms and Blight Designation is sent to the property owner.
  • The property owner can appeal for Blight Designation.
  • Properties that were not appealed are declared Blighted by the court are placed on the Community Redevelopment Tax Incentive Program(CRTIP) list to submit to the Tax Commissioner. The list is due each year in August.

Nuisance Per Se(NPS)

  • Code Enforcement Officer locates abandoned structure.
  • Multiple photos are taken.
  • Photos and Q-public are submitted to the Code Enforcement Director for approval.
  • Photos and Q-public are provided to county attorneys.
  • The County attorney reviews information and decides if it will be NPS or Blight Tax.
  • NPS letters go out to property owners.
  • Property owners can select option #1 repair or demolish themselves or option #2 MBC conducts the demolition.
  • If the property owner chooses option #1, they must show good faith effort of trying to improve the property within 60 to 90 days.
  • Option #2, a list is provided to the demo company for demolition.
