Men indicted in Waffle House shooting

Macon — Bibb County grand jurors indicted two men Tuesday in connection with an Aug. 30 shooting at Waffle House, 4094 Pio Nono Avenue.

Christopher Allen Powell, 30, of Gray, and Johntellis Montez Mathis, 30, of Macon, are charged with two counts of aggravated assault and three counts of violating Georgia’s Street Gang Terrorism and Prevention Act stemming from allegations they assaulted and shot a man and shot toward a second person at the restaurant. Mathis additionally is charged with possession of a firearm by a first offender probationer and a fourth count of violating the gang act. Both men are alleged to be associated with Blacc Team, a division of the Gangster Disciples street gang.

A separate indictment charges Powell with aggravated assault and violating the gang act stemming from allegations he shot a man on Glendale Avenue May 27. The indictment further charges Powell with aggravated battery-family violence and a gang act violation stemming from a June 18 incident at a home on Jeffersonville Road.  Powell also is charged with home invasion, two counts of aggravated assault and one count of violating the gang act from an alleged Aug. 13 incident at a Jeffersonville Road home.

An indictment is a charging document issued by grand jurors if the group determines probable cause exists for the case to move forward toward trial.  Each defendant is presumed to be innocent unless and until they are proven guilty in a court of law.
