Macon – A judge sentenced a Macon man to serve 25 years in prison Monday in the 2015 rape of a mentally ill and intellectually disabled woman behind the Kroger supermarket on North Avenue.
Bibb County jurors deliberated for less than an hour before finding 25-year-old David Lee Davis guilty in February. Davis must serve his entire sentence without the possibility of parole. After his release must abide by sex offender conditions of probation for the remainder of his life.
Prosecutors Shelley Milton and Jonathan Gordon sought the maximum sentence allowed by law – life in prison without the possibility of parole. The defense contended Davis also suffers from learning disabilities although no supporting documents were presented as evidence during the trial.
Evidence presented during the trial showed:
Davis forced a then-21-year-old woman to have sex against her will.
A doctor testified the woman suffers from mental illness and intellectual disabilities that would have rendered her unable to consent to a sex act. Although she is biologically an adult, she has the mind of a 10-year-old.
GBI experts testified DNA from both Davis and the woman was found on two condoms retrieved from the crime scene.
During Monday’s hearing, a judge also found Davis guilty of violating his first offender probation on a 2011 burglary case. Davis was adjudicated guilty on the burglary charge and resentenced to serve 20 years in prison. He will serve the rape and burglary sentences simultaneously.
Speaking after the sentencing, Macon Judicial Circuit District Attorney David Cooke said, “Mr. Davis took advantage of one of our most vulnerable citizens in one of the worst ways possible. This sentence ensures he won’t be able to hurt anyone else for many years to come.”
